Regulations

The Website MADU-MIODU.COM.MY is owned and operated by MADU MIODU SDN BHD (“MADU MIODU”), with its registered office at: Suite 33-01, 33rd Floor, Menara Keck Seng, 203 Jalan Bukit Bintang, 55100 Kuala Lumpur, Malaysia, operating under the registered number 202401029957 (1575806-P). It is an online store selling official MADU MIODU products.

These Regulations of the Online Store define the rules for making purchases in the MADU MIODU online store, in particular the policy and procedure for concluding distance sales contracts via the Store, as well as the complaint procedure and the procedure of withdrawal from the contract by the Consumer.

The Regulations are addressed to all Shop Customers. All Customers are obliged to read the provisions of the Regulations before making a purchase. Each Client is obliged to comply with the provisions of the Regulations. The sale is based on the version of the Regulations, valid at the time of placing the order.

General conditions

  • The online store may only be used by persons over 18 years of age. By using this website, you confirm you are at least 18 years old and agree to comply with Malaysia’s Consumer Protection Act 1999 and PDPA 2010.
  • Persons registering in the online store and making purchases there provide their personal data, which MADU MIODU processes on the principles indicated in the Privacy Policy.

ACCOUNTs

  • In order to use certain features of the Website (e.g., purchasing products and services (referred to collectively as “Products” herein) from the Web site), you must register for an account with MADU-MIODU.COM.MY and provide certain information about yourself as prompted by the Website registration form. You represent and warrant that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; and (c) your use of the Website does not violate any applicable law or regulation or the terms of this Agreement. You may delete your MADU-MIODU.COM.MY Account at any time, for any reason, by contacting us via email at customer-services@madu-miodu.com.my.
  • You are solely responsible for protecting the security and confidentiality of the password and identification selected by you. You shall immediately notify us of any unauthorized use of your password or identification or any other breach or threatened breach of this Site’s security. Each time you use a password or identification, you will be deemed to be authorized to access and use the Website in a manner consistent with these Terms, and We have no obligation to investigate the authorization or source of any such access or use of this Site. YOU WILL BE SOLELY RESPONSIBLE FOR ALL ACCESS TO AND USE OF THIS WEBSITE BY ANYONE USING THE PASSWORD AND IDENTIFICATION ORIGINALLY SELECTED BY YOU WHETHER OR NOT SUCH ACCESS TO AND USE OF THIS WEBSITE IS ACTUALLY AUTHORIZED BY YOU, INCLUDING WITHOUT LIMITATION, ALL COMMUNICATIONS AND TRANSMISSIONS AND ALL OBLIGATIONS (INCLUDING WITHOUT LIMITATION FINANCIAL OBLIGATIONS) INCURRED THROUGH SUCH ACCESS OR USE.
  • You are responsible for maintaining the confidentiality of your MADU-MIODU.COM.MY Account login information. You are fully responsible for all activities that are associated with your MADU-MIODU.COM.MY Account (including but not limited to any purchases, use of the Website, or correspondence from your account to MADU MIODU). You agree to immediately notify MADU MIODU of any unauthorized use or suspected unauthorized use of your MADU-MIODU.COM.MY Account or any other breach of security. When you provide MADU MIODU with such notice, MADU MIODU will suspend or otherwise secure your Account to prevent future unauthorized activity.

We may also use personal information in other ways for which we provide notice at the time of collection as may be required by applicable laws, or without notice to you for any legally permissible purpose and subject to applicable laws.

Electronic Communication

When you use this Website, or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this Website or through our other services. You agree that all agreements, notices, disclosures and other communication that we provide to you electronically satisfy any legal requirements that such communications be in writing.

Terms of Sale

  • Products and Pricing. All Products or services listed on the Website are subject to change, as is Product information, pricing, and availability. We reserve the right, at any time, to modify, suspend, or discontinue any Website feature or the sale of any Product with or without notice. You agree that we will not be liable to you or to any third party for any modification, suspension, or discontinuance of any Website feature or Product. In the event a Product is listed at an incorrect price or with incorrect information, we shall have the right, prior to the acceptance of your order (as described in Section “Orders” below), to decline or cancel any such orders, whether or not the order has been confirmed and/or your credit card account charged. If your credit card has already been charged for the order and we cancel your order, we will issue a credit to your credit card account in the amount of the charge.
  • Payment Terms. For each Product you order on the Website, you agree to pay the price applicable for the Product as of the time you submitted your order (“Product Price”), the delivery fees for the delivery service you select (“Delivery Fees”), and any applicable Taxes (defined below). MADU MIODU will automatically bill your credit card account submitted as part of the order process for such amounts, and you hereby authorize us to do so. You will be solely responsible for payment of all taxes (other than taxes directly imposed on MADU MIODU’s business activity in a state, such as income taxes), fees, duties, and other governmental charges, and any related penalties and interest, arising from the Product purchase (“Taxes”) not withheld by MADU MIODU. All payments are non-refundable (except as expressly set forth in Section “Products and Pricing” and “Orders”).
  • Orders. Your receipt of an order confirmation from us does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline or cancel your order (in whole or in part) for any reason. If a given product is not in stock or the order cannot be fulfilled for another reason, the Customer will be informed about it by email. In particularly justified cases, MADU MIODU may refuse to conclude a sales agreement in order to protect its assets.
  • Shipping Policy. Any delivery dates provided by MADU MIODU are estimates. MADU MIODU reserves the right to make deliveries in installments. MADU MIODU will send you an email when your order has shipped and you may review your order and shipping information on your MADU-MIODU.COM.MY Account page.
  • Return Policy. Due to the perishable nature of honey, returns are only accepted for damaged, defective, or incorrectly shipped items. Please contact our Customer Service for assistance. Please have following information when you contact us: order number, date of arrival, condition of product at time of arrival, and detailed explanation of the issue.   • Complaints. Complaints may be reported by email, to the email address customer-services@madu-miodu.com.my. Please have following information when you contact us: the data of the person submitting the complaint (name, postal address, email address and contact phone number); indicating the reason for the complaint and the content of the request; order number; date of arrival; and the original or copy of the proof of purchase (e.g. a receipt or invoice) may make it easier to submit a complaint.

Pricing and Payment

  • All prices are listed in MYR. The prices of the products do not include the cost of delivery. All prices display exclude Sales and Service Tax (SST). Applicable taxes will be displayed at checkout.
  • Payments must be made in full at the time of purchase through the payment methods provided on the website.

Intellectual Property and Ownership

  • All content on this website, including text, images, logos, and product descriptions, is the property of MADU MIODU SDN BHD.
  • Unauthorized use or reproduction of content is strictly prohibited.

Links to other websites are provided for the convenience of users. We are unable to provide any warranty regarding the accuracy or completeness of the content of such sites, or the reliability, quality or effectiveness of any products provided through external websites. A link to an external site does not imply an endorsement of the views, information or products provided or held by such websites. You acknowledge that MADU MIODU are not responsible for the operation of or content located on or through any such site.

Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify and hold harmless MADU MIODU and affiliates, and our respective officers, directors, agents, partners, members, employees, independent contractors, service providers and consultants, from and against any claims, damages, costs, liabilities and expenses arising out of or related to (a) your access to and use or misuse of this Website; (b) any User Content you post, upload, use, distribute, store or otherwise transmit on or through this Website; (c) any Feedback that you provide; (d) your violation of these Terms; and (e) your violation of any rights of another. You agree to promptly notify MADU MIODU of any third party Claims, cooperate with MADU MIODU in defending such Claims and pay all fees, costs and expenses associated with defending such Claims (including but not limited to attorneys’ fees). MADU MIODU SDN BHD reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us and you agree to cooperate with our defense of these claims. You further agree that the MADU MIODU shall have the right to control of the defense or settlement of any third party Claims.

Limitation on Liability

IN NO EVENT SHALL MADU MIODU SDN BHD, OUR OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUBSIDIARIES, PARENTS, JOINT VENTURES, SUCCESSORS AND ANY OTHER COMPANIES UNDER COMMON CONTROL WITH US BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFIT OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE, PRODUCTS, OR THIRD PARTY SITES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
ACCESS TO, AND USE OF, THE WEBSITE, PRODUCTS AND THIRD PARTY SITES ARE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA RESULTING THEREFROM.

Arbitration

You agree that any dispute or claim relating in any way to your MADU-MIODU purchase, use of any Product, or use of the Website will be resolved by binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

For all disputes, you must first give us an opportunity to resolve your claim by sending a written description of your claim to MADU MIODU SDN BHD, attn.: Legal, Suite 33-01, 33rd Floor, Menara Keck Seng, 203 Jalan Bukit Bintang, 55100 Kuala Lumpur, Malaysia. We each agree to negotiate your claim in good faith.

Disclaimers

Except as expressly provided, this Website, including all Website Content, and services provided on or in connection with this Website are provided on an “AS IS” and “WITH ALL FAULTS” basis without representations, warranties or conditions of any kind, either express or implied. MADU MIODU DISCLAIM ALL OTHER REPRESENTATIONS, WARRANTIES, CONDITIONS AND DUTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES, DUTIES OR CONDITIONS: (A) OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, RESULTS, TITLE, AND NON-INFRINGEMENT; AND (B) CREATED BY TRADE USAGE, COURSE OF DEALING OR COURSE OF PERFORMANCE. MADU MIODU does not represent or warrant that this Website is accurate, complete, reliable, current or error-free. MADU MIODU do not represent or warrant that this Website or our servers are free of viruses or other harmful components.

Modification to website

MADU MIODU reserves the right, at any time, to modify, suspend, or discontinue the Website or any part thereof with or without notice. You agree that MADU MIODU will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Website or any part thereof.

Term and Termination

Subject to this Section, this Agreement will remain in full force and effect while you use the Website. We may (a) suspend your rights to use the Website (as well as your MADU-MIODU.COM.MY Account) or (b) terminate this Agreement, at any time for any reason at our sole discretion, including for any use of the Website in violation of this Agreement or if we believe you are younger than 18. Upon termination of this Agreement, your MADU-MIODU.COM.MY Account and right to access and use the Web site will terminate immediately. You understand that any termination of your MADU-MIODU.COM.MY Account may involve deletion of any User Content you may have posted. MADU-MIODU SDN BHD will not have any liability whatsoever to you for any termination of this Agreement, including for termination of your MADU-MIODU.COM.MY Account or deletion of your User Content. Even after this Agreement is terminated, some part of the provisions of this Agreement will remain in effect.

Changes to our Regulations

This Regulations is subject to occasional revision. Any revised version will be deemed to be applicable from the first date of publication on this website. Continued use of our Website shall indicate your acknowledgement of such changes and agreement to be bound by the any revision of these terms and conditions.
